Following the Petroleum Industry Act, upstream regulation sits with the Nigerian Upstream Petroleum Regulatory Commission, while midstream and downstream sit with the NMDPRA. Service companies need the permit that matches the category of work they intend to perform.
Understanding permit categories
Permits are granted by service category — for example general oilfield services, engineering and construction, marine and logistics, inspection and certification, or waste management. You may only bid for and perform work within the categories on your permit, and each additional category attracts its own fee.
Core requirements
Applications are assessed on corporate standing as much as technical capability.
- CAC certificate of incorporation, memorandum and articles, and current annual returns
- Tax clearance certificate for the last three years
- PENCOM, ITF, NSITF and BPP compliance certificates
- Financial statements
- Evidence of technical capability: equipment, personnel CVs and relevant certifications
- Nigerian Content Equipment Certificate and NCDMB registration where applicable
Why applications get rejected
The most common reasons are lapsed CAC annual returns, expired compliance certificates, mismatched company details across documents, and applying for categories the company cannot demonstrate capability in. Almost all of these are avoidable with a proper pre-application review.
Renewals
Permits are renewed annually and lapse without grace. Because renewal depends on tax and statutory certificates that themselves take weeks to obtain, the renewal cycle should start at least three months before expiry.
